Three contracts between Jews and Arabs regarding the sale of Lulavim (palm fronds) from the twenties and thirties
Three contracts that attest to a business agreement between the rabbis of Jerusalem and an Arab family from Nebi-Samuel regarding the buying of palm fronds.
1. 15/7/1929
The contract specifies the obligations of each of the parties. Party A is the buyer and Party B, the seller. Party B is obliged to sell at least 5,500 palm fronds to Party A. The Palm fronds will be brought form Jordan and will be elegant and beautiful. Party B is obliged to maintain exclusivity and to sell only to Party A, and especially not to sell to the family of Rabbi Ascher Baharan, who was one of the builders of Jerusalem and redeemer of the lands of Nebi-Samuel. The contract also specifies the payment conditions etc.
On behalf of the buyer (Party A) are signed Rabbi Yisrael Ze'ev Mintzberg – Rosh Av Beit Din Badatz Ha'Chassidim in Jerusalem and the rabbi of the 'Upper City', a neighborhood in the Old City; Rabbi Shai Friend; Rabbi Zalman Goldberg; and the yeshiva students Reb Aharon Elba and Reb Yosef Chaim Herschler, the heads of the settlers of 'Nachalat Yisrael Rama' near the tomb of the Prophet Samuel.
On behalf of the seller (party B) are signed Shavda Ahmed and his son Barakat from Nebi-Samuel.
It seems that there was a conflict between the settlers of 'Nachalat Yisrael Rama' in Nebi-Samuel and the descendants of Rabbi Baharan, maybe concerning the rights of the land. It should be noted that the wife of Rabbi Mintzberg, who signed the contract, was from the extended family of Rabbi Ascher Baharan.
The contract is typewritten and hand-signed.
2. 21.2.1930
The contract specifies the obligations of the parties as in the above item.
On behalf of the buyer (Party A) are signed the yeshiva students Reb Aharon Elba and Reb Yosef Chaim Herschler, the heads of the settlers of 'Nachalat Yisrael Rama' near the tomb of the Prophet Samuel.
On behalf of the seller (party B) are signed Shavda Ahmed and his son Barakat from Nebi-Samuel.
The contract is typewritten and hand-signed.
On the other side of the contract there is a hand-written statement of Party B about receiving the first payment from Party A. The statement is signed with a ring.
3. 31.5.1926 – A statement of the Arab buyer
A statement of Shavda Ahmed, the above seller, in which he pledges not to violate the agreements between him and the buyers of the palm fronds. There is also reference to Rabbi Ascher Baharan, which denies him the rights of buying the fronds.
The statement is signed with a ring/stamp.
